{"id":10951,"date":"2020-10-16T05:19:15","date_gmt":"2020-10-16T12:19:15","guid":{"rendered":"https:\/\/worldcampaign.net\/?p=10951"},"modified":"2020-10-16T05:19:15","modified_gmt":"2020-10-16T12:19:15","slug":"the-observer-view-on-the-information-commissioners-cambridge-analytica-investigation-the-observer","status":"publish","type":"post","link":"https:\/\/worldcampaign.net\/?p=10951","title":{"rendered":"&#8220;The Observer view on the information commissioner&#8217;s Cambridge Analytica investigation&#8221;, The Observer"},"content":{"rendered":"<p>Editorial, London, 11 October 2020<\/p>\n<p><em>This newspaper\u2019s expos\u00e9 of the exploitation of private data has been vindicated<\/em><\/p>\n<p><span class=\"drop-cap\"><span class=\"drop-cap__inner\">T<\/span><\/span>he 2018 <em>Observer<\/em> <a class=\"u-underline\" href=\"https:\/\/www.theguardian.com\/news\/series\/cambridge-analytica-files\" data-link-name=\"in body link\">investigation<\/a> into a hitherto obscure political consultancy sparked the most serious crisis yet to disrupt the world\u2019s secretive social media giants and shed terrifying light on how their collection of our data reshaped political campaigning.<\/p>\n<p>Today, Cambridge Analytica is a household name. But renewed controversy about the activities of the <a class=\"u-underline\" href=\"https:\/\/www.theguardian.com\/uk-news\/2018\/may\/02\/cambridge-analytica-closing-down-after-facebook-row-reports-say\" data-link-name=\"in body link\">now defunct<\/a> company demonstrates how our media and legislatures are still struggling to digest the full implications of the scandal.<\/p>\n<p>Last week, Britain\u2019s information commissioner, Elizabeth Denham, announced she had wrapped up a long investigation into the use of personal data in political campaigning in <a class=\"u-underline\" href=\"https:\/\/ico.org.uk\/media\/action-weve-taken\/2618383\/20201002_ico-o-ed-l-rtl-0181_to-julian-knight-mp.pdf\" data-link-name=\"in body link\">a letter to parliament<\/a> that warned of \u201csystemic vulnerabilities in our democratic systems\u201d. The letter confirmed that Cambridge Analytica had exploited Facebook data and said that, as investigators closed in on the company, it drew up plans to take its data offshore to avoid scrutiny.<\/p>\n<p>The commissioner summed up how reporting on this topic, led by Pulitzer-nominated <a class=\"u-underline\" href=\"https:\/\/www.theguardian.com\/uk-news\/2019\/mar\/17\/cambridge-analytica-year-on-lesson-in-institutional-failure-christopher-wylie\" data-link-name=\"in body link\">Carole Cadwalladr<\/a> in the <em>Observer<\/em>, transformed the way that people around the world understood the value of their personal data and their relationships with social media giants. \u201cHow people\u2019s information was being used became a dinner table topic, prompting undercover news reports, a TV dramatisation and a Netflix documentary,\u201d <a class=\"u-underline\" href=\"https:\/\/ico.org.uk\/about-the-ico\/news-and-events\/news-and-blogs\/2020\/10\/blog-the-conclusion-of-the-ico-s-investigation-into-the-use-of-personal-data-in-political-campaigning\/\" data-link-name=\"in body link\">said <\/a><a class=\"u-underline\" href=\"https:\/\/ico.org.uk\/about-the-ico\/news-and-events\/news-and-blogs\/2020\/10\/blog-the-conclusion-of-the-ico-s-investigation-into-the-use-of-personal-data-in-political-campaigning\/\" data-link-name=\"in body link\">Denham<\/a>.<\/p>\n<aside class=\"element element-rich-link element-rich-link--tag element--thumbnail element-rich-link--upgraded\" data-component=\"rich-link-tag\" data-link-name=\"rich-link-tag\">\n<div class=\"rich-link tone-news--item rich-link--pillar-news\"><\/div>\n<\/aside>\n<p>Denham underlined that the investigation led to fines on Vote Leave, Leave.EU and Facebook, with the latter \u201cgiven the maximum financial penalty we could levy\u201d. <a class=\"u-underline\" href=\"https:\/\/www.theguardian.com\/uk-news\/cambridge-analytica\" data-link-name=\"auto-linked-tag\" data-component=\"auto-linked-tag\">Cambridge Analytica<\/a> has since collapsed; if it hadn\u2019t, it would probably have attracted further regulatory action, she added.<\/p>\n<p>The investigation and its findings might have been expected to prompt alarm and a debate about protecting our data and our democracy. Instead, comment over the past week has largely dismissed its findings or misread them. Several focused on CA\u2019s purchase and use of commercially available personal data and software, as if that negated the exploitation of Facebook users\u2019 private profiles. But the company was always open about using commercial software and data; that was combined with information scraped from <a class=\"u-underline\" href=\"https:\/\/www.theguardian.com\/technology\/facebook\" data-link-name=\"auto-linked-tag\" data-component=\"auto-linked-tag\">Facebook<\/a> to give it an unmatched ability to profile US voters.<\/p>\n<p>One <a class=\"u-underline\" href=\"https:\/\/ftalphaville.ft.com\/2020\/10\/06\/1602008755000\/ICO-s-final-report-into-Cambridge-Analytica-invites-regulatory-questions\/\" data-link-name=\"in body link\">report claimed<\/a> that the Information Commissioner\u2019s Office (ICO) had \u201c[dispelled] many of the accusations put forward by whistleblowers and digital rights campaigners\u201d, listing concerns about Russian interference in Brexit and interference in the 2016 presidential election. Yet the ICO confirmed that CA and its partner companies held on to parts of the Facebook data until at least 2017 and used it for political campaigning. \u201cIt is suspected\u201d that those campaigns included the 2016 US presidential election, the ICO\u2019s letter notes.<\/p>\n<div id=\"dfp-ad--inline1\" class=\"js-ad-slot ad-slot ad-slot--inline ad-slot--inline1 ad-slot--outstream ad-slot--rendered\" data-link-name=\"ad slot inline1\" data-name=\"inline1\" data-mobile=\"1,1|2,2|300,197|300,250|300,274|fluid\" data-phablet=\"1,1|2,2|300,197|300,250|300,274|620,350|550,310|fluid\" data-desktop=\"1,1|2,2|300,250|300,274|620,1|620,350|550,310|fluid\" data-google-query-id=\"CJCC596KuewCFdU4YgodCcwFYw\">\n<p>A devastating <a class=\"u-underline\" href=\"https:\/\/www.channel4.com\/news\/revealed-trump-campaign-strategy-to-deter-millions-of-black-americans-from-voting-in-2016\" data-link-name=\"in body link\">Channel 4 report<\/a> claimed recently that Donald Trump\u2019s 2016 campaign worked with a team from Cambridge Analytica and used data to target black voters for suppression through ads on Facebook.<\/p>\n<p>On Russian meddling, the ICO said that possible evidence it had found of \u201cRussia-located activity\u201d fell beyond its remit and had been referred to the National Crime Agency for further investigation. Beyond that, it noted no \u201cadditional evidence of Russian involvement\u201d in material on the CA servers it seized; it stretches credulity to present that as a full investigation into potential Russian influence on <a class=\"u-underline\" href=\"https:\/\/www.theguardian.com\/politics\/eu-referendum\" data-link-name=\"auto-linked-tag\" data-component=\"auto-linked-tag\">Brexit<\/a>.<\/p>\n<p>Other reports focused on the ICO\u2019s confirmation of its earlier conclusion that CA was not actively involved in the Brexit referendum, while inexplicably ignoring its findings about the Canadian data company <a class=\"u-underline\" href=\"https:\/\/www.theguardian.com\/uk-news\/2018\/mar\/31\/aggregateiq-canadian-tech-brexit-data-riddle-cambridge-analytica\" data-link-name=\"in body link\">AggregateIQ<\/a> (AIQ), which did <a class=\"u-underline\" href=\"https:\/\/www.theguardian.com\/uk-news\/2018\/mar\/24\/aggregateiq-data-firm-link-raises-leave-group-questions\" data-link-name=\"in body link\">work on the winning Vote Leave campaign<\/a> and was described by whistleblowers as an unofficial \u201cdepartment\u201d of the scandal-hit firm.<\/p>\n<p>The ICO said there was a range of evidence demonstrating a \u201cvery close relationship\u201d with <a class=\"u-underline\" href=\"https:\/\/www.theguardian.com\/uk-news\/2018\/may\/05\/cambridge-analytica-scl-group-new-companies-names\" data-link-name=\"in body link\">Cambridge Analytica\u2019s parent company, SCL<\/a>, which included paying some of AIQ\u2019s Facebook invoices, but didn\u2019t untangle it further. AIQ denies having a relationship that went beyond that between a software developer and its client.<\/p>\n<p>Media reporting, including the <em>Observer<\/em>\u2019s, has always focused on AIQ. It was Cambridge Analytica employees, and figures from the unofficial Leave.EU campaign, who claimed in the aftermath of the vote that the company played a large role, before later back-pedalling.<\/p>\n<p>Critics of Cadwalladr\u2019s reporting argue that \u201cCambridge Analytica\u2019s main data-related crime was overselling its own capabilities rather than actually hacking democracy\u201d. Others have resorted to trolling and personal attacks, often laced with misogyny. Yet her exposure of Cambridge Analytica prompted political and judicial inquiries on both sides of the Atlantic and permanently altered public understanding of data abuse. It paved the way for sweeping changes to how social media companies regulate political campaigns and advertising.<\/p>\n<p>The ICO report confirmed massive mishandling of private data and its exploitation for political campaigning.
