But Tuesday brought an unusual show of unanimous support across party lines as lawmakers linked arms to hear former Facebook employee Frances Haugen detail the ways in which she says the social media giant knowingly pushes and profits off products that harm children.<\/p>\n<aside class=\"story-enhancement\">\n<div id=\"pol-05-wrap\" class=\"content-group ad  is-loaded\"><\/div>\n<\/aside>\n<p class=\" story-text__paragraph\">She asked for their help, and they made a case for why this time will be different.<\/p>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<div class=\"container__column container__column--story hide-under-small\"><\/div>\n<\/div>\n<\/section>\n<section class=\"page-content__row page-content__row--story main-section\" data-content-section=\"6\">\n<div class=\"container container--story story-layout--fixed-fluid\">\n<div class=\"container__column container__column--story\">\n<div class=\"container__row container__row--story story-layout--fluid-fixed\">\n<div class=\"container__column container__column--story center-horizontally\">\n<div class=\"story-text\">\n<p class=\" story-text__paragraph\" data-content-child-index=\"0-0\">&#8220;There&#8217;s always reason for skepticism about Congress acting on any issue,\u201d Sen. Richard Blumenthal (D-Conn.), who chairs the consumer protection panel that convened Tuesday\u2019s session, said after the hearing. But at the same time, he said, \u201cthere are times when the dynamic is so powerful that something actually is done \u2014 and I think this issue may be one where the power of bipartisan outrage and support really enabled us to cross the finish line.\u201d<\/p>\n<p class=\" story-text__paragraph\" data-content-child-index=\"0-1\">\u201cI have rarely \u2014 if ever \u2014 seen the kind of unanimity on display today,&#8221; he said.<\/p>\n<p class=\" story-text__paragraph\" data-content-child-index=\"0-2\">Even some with ties to Facebook described this as a possible turning point. Katie Harbath, who until this year was a public policy director at Facebook, called Tuesday\u2019s session \u201cthe most substantial hearing we&#8217;ve ever had on tech.\u201d<\/p>\n<p class=\" story-text__paragraph\" data-content-child-index=\"0-3\">&#8220;I don&#8217;t think this moment alone all of a sudden is like, \u2018We&#8217;ve got legislation!&#8217;\u201d she said in an interview. \u201cBut I put it on the level of milestones of crises \u2014 the <a href=\"https:\/\/www.politico.com\/story\/2017\/10\/29\/facebook-russia-narrative-244285\" target=\"_blank\">Russian ads<\/a>, <a href=\"https:\/\/www.politico.com\/story\/2018\/04\/11\/zuckerberg-hearings-facebook-congress-477287\" target=\"_blank\">Cambridge Analytica<\/a> \u2014 for the company that I think is entering us into a new era.&#8221;<\/p>\n<p class=\" story-text__paragraph\" data-content-child-index=\"0-4\">Here\u2019s are POLITICO\u2019s biggest takeaways from Haugen\u2019s testimony, including new details about the way Facebook operates and her recommendations for how Congress can crack down on the company\u2019s behavior.<\/p>\n<div class=\"teads-inread sm-screen\">\n<div>\n<div id=\"teads0\" class=\"teads-player\"><\/div>\n<h2 data-content-child-index=\"0-5\">Whistleblower torpedoes some of Congress\u2019 tech agenda<\/h2>\n<p class=\" story-text__paragraph\" data-content-child-index=\"0-6\">\nThe hearing was notable for its lack of the partisan sparring that has <a href=\"https:\/\/www.politico.com\/news\/2021\/06\/24\/house-panel-green-lights-early-tech-antitrust-bills-as-marathon-session-grinds-on-495897\" target=\"_blank\">marked some recent tech blockbusters<\/a> in Congress \u2014 even as Haugen shot down some of the top proposals lawmakers have offered for regulating the industry.<\/p>\n<p class=\" story-text__paragraph\" data-content-child-index=\"0-7\">She advised lawmakers both against trying to separate Instagram from Facebook, as many Democrats have advocated, or narrowing the types of speech covered by an online liability shield known as Section 230.<\/p>\n<\/div>\n<\/div>\n<div class=\"container__column container__column--story center-vertically right-zone hide-under-small\"><\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/section>\n<section class=\"page-content__row page-content__row--story is-full-width-bleed\" data-ad-section=\"6\">\n<aside class=\"story-enhancement\">\n<div class=\"ad is-loaded\"><\/div>\n<\/aside>\n<\/section>\n<section class=\"page-content__row page-content__row--story main-section\" data-content-section=\"11\">\n<div class=\"container container--story story-layout--fixed-fluid\">\n<div class=\"container__column container__column--story\">\n<div class=\"container__row container__row--story story-layout--fluid-fixed\">\n<div class=\"container__column container__column--story center-horizontally\">\n<div class=\"story-text\">\n<p class=\" story-text__paragraph\" data-content-child-index=\"0-0\">\u201cI\u2019m actually against the breaking up of Facebook,\u201d she told the senators, adding that such a split would not solve the problems that lawmakers care about.<\/p>\n<p class=\" story-text__paragraph\" data-content-child-index=\"0-1\">\u201cIf you split Facebook and Instagram apart, it\u2019s likely that most advertising dollars would go to Instagram, and Facebook will continue to be this Frankenstein that is endangering lives around the world,\u201d Haugen said. In that situation, she added, the cash boost to Instagram would mean fewer resources for Facebook to address its problems.<\/p>\n<p class=\" story-text__paragraph\" data-content-child-index=\"0-1\">Instead, she recommended the creation of a federal regulatory agency \u2014 an oversight board of sorts, authorized by Congress \u2014 that would help analyze tech companies\u2019 research, activities and transparency and craft appropriate regulations.<\/p>\n<p class=\" story-text__paragraph\" data-content-child-index=\"0-4\">\u201cFinding collaborative solutions with Congress is going to be key because these systems are going to continue to exist and be dangerous, even if broken up,\u201d she said.<\/p>\n<p class=\" story-text__paragraph\" data-content-child-index=\"0-5\">Haugen also urged lawmakers to recast their approach to Section 230, the 1996 statute that shields internet platforms from legal liability for content that users post. The provision has sharply divided the parties, with many Democrats and Republicans at odds on whether the main problems with tech platforms involve hate speech and disinformation or censorship.<\/p>\n<\/div>\n<\/div>\n<div class=\"container__column container__column--story center-vertically right-zone hide-under-small\"><\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/section>\n<section class=\"page-content__row page-content__row--story is-full-width-bleed\" data-ad-section=\"11\">\n<aside class=\"story-enhancement\">\n<div class=\"ad is-loaded\"><\/div>\n<\/aside>\n<\/section>\n<section class=\"page-content__row page-content__row--story main-section\" data-content-section=\"19\">\n<div class=\"container container--story story-layout--fixed-fluid\">\n<div class=\"container__column container__column--story\">\n<div class=\"container__row container__row--story story-layout--fluid-fixed\">\n<div class=\"container__column container__column--story center-horizontally\">\n<div class=\"story-text\">\n<p class=\" story-text__paragraph\" data-content-child-index=\"0-0\">Rather than focus on the content of what users post online, Haugen urged the lawmakers to alter the statute to hold companies accountable for the algorithms that decide which content users see.<\/p>\n<p class=\" story-text__paragraph\" data-content-child-index=\"0-1\">Tech companies have relatively little control over user-generated content, making it more difficult to alter Section 230 on that basis, Haugen said, but \u201cthey have 100 percent control over their algorithms, and Facebook should not get a free pass on choices it makes to prioritize growth and virality and reactiveness over public safety.\u201d<\/p>\n<p class=\" story-text__paragraph\" data-content-child-index=\"0-2\">Spokespeople for Facebook dismissed Haugen\u2019s credentials after the hearing, emphasizing that she\u2019d worked for Facebook for only a short time, never attended a meeting with top executives and did not work directly on some of the chief issues she testified about.<\/p>\n<p class=\" story-text__paragraph\" data-content-child-index=\"0-3\">But Blumenthal described Haugen \u2014 a former debate team captain in her native Iowa, according to <a href=\"https:\/\/www.press-citizen.com\/story\/news\/2021\/10\/05\/facebook-whistleblower-frances-haugen-had-studious-iowa-city-childhood-instagram\/6004128001\/?utm_source=ourcommunitynow&amp;utm_medium=web\" target=\"_blank\">local news reports<\/a> \u2014 as \u201celoquent and persuasive.\u201d And he told reporters after the hearing that all of the changes Haugen proposed deserve \u201cserious consideration.\u201d<\/p>\n<p class=\" story-text__paragraph\" data-content-child-index=\"0-4\">Blumenthal and Sen. Marsha Blackburn of Tennessee, the top Republican on the consumer protection panel, said people can expect to see movement first on bipartisan legislation to boost children\u2019s protections and update long-existing online children\u2019s privacy laws.<\/p>\n<p class=\" story-text__paragraph\" data-content-child-index=\"0-5\">Bipartisan legislation dealing with protections for children and teens is \u201clikely the only issue which Congress can immediately rally around,\u201d said Jeff Chester, executive director of the nonprofit Center for Digital Democracy.<\/p>\n<h2 data-content-child-index=\"0-6\">Lawmakers blame tech lobbyists for Congress\u2019 inaction<\/h2>\n<p class=\" story-text__paragraph\" data-content-child-index=\"0-7\">\nMembers of the panel agreed about the need to push ahead with tech regulations and consumer protections \u2014 showing a consensus and hunger not seen across the board at any other major tech hearing in recent memory.<\/p>\n<p class=\" story-text__paragraph\" data-content-child-index=\"0-8\">But some vented frustrations about how it has been hard to achieve any of their shared goals. And for that, they blamed tech lobbyists.<\/p>\n<\/div>\n<\/div>\n<div class=\"container__column container__column--story center-vertically right-zone hide-under-small\"><\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/section>\n<section class=\"page-content__row page-content__row--story is-full-width-bleed\" data-ad-section=\"19\">\n<aside class=\"story-enhancement\">\n<div class=\"ad is-loaded\"><\/div>\n<\/aside>\n<\/section>\n<section class=\"page-content__row page-content__row--story main-section\" data-content-section=\"27\">\n<div class=\"container container--story story-layout--fixed-fluid\">\n<div class=\"container__column container__column--story\">\n<div class=\"container__row container__row--story story-layout--fluid-fixed\">\n<div class=\"container__column container__column--story center-horizontally\">\n<div class=\"story-text\">\n<p class=\" story-text__paragraph\" data-content-child-index=\"0-0\">Congress has \u201cdone nothing\u201d to meaningfully tackle the problems surrounding Facebook, like children\u2019s privacy and safety, due to the intense lobbying efforts of the tech industry, Sen. Amy Klobuchar (D-Minn.) said during the hearing.<\/p>\n<p class=\" story-text__paragraph\" data-content-child-index=\"0-1\">\u201cWe have not done anything to update our privacy laws in this country \u2014 our federal privacy laws \u2014 nothing, zilch, in any major way,&#8221; said Klobuchar, who chairs the Senate Judiciary Committee\u2019s antitrust panel. &#8220;Why? Because there are lobbyists around every single corner of this building that have been hired by the tech industry.\u201d<\/p>\n<p class=\" story-text__paragraph\" data-content-child-index=\"0-2\">But both Republicans and Democrats said the whistleblower\u2019s testimony would be a catalyst for action.<\/p>\n<p class=\" story-text__paragraph\" data-content-child-index=\"0-3\">\u201cThe conversation so far reminds me that you and I ought to resolve our differences and introduce legislation,\u201d Sen. Jerry Moran (R-Kan.) told Blumenthal during the hearing.<\/p>\n<p class=\" story-text__paragraph\" data-content-child-index=\"0-4\">\u201cOur differences seem very minor in the face of the revelations that we\u2019ve now seen,\u201d Blumenthal responded.<\/p>\n<p class=\" story-text__paragraph\" data-content-child-index=\"0-5\">Blumenthal later told reporters the testimony had provided an impetus for Congress to move on a national privacy bill and children\u2019s protections under <a href=\"https:\/\/www.markey.senate.gov\/news\/press-releases\/senators-markey-and-blumenthal-rep-castor-reintroduce-legislation-to-protect-children-and-teens-from-online-manipulation-and-harm\" target=\"_blank\">the KIDS Act<\/a>, which places guardrails on features that amplify certain kinds of content.<\/p>\n<h2 data-content-child-index=\"0-6\">Facebook&#8217;s hiring struggles give new meaning to \u2018big is bad\u2019<\/h2>\n<p class=\" story-text__paragraph\" data-content-child-index=\"0-7\">\nOne reason Facebook struggles to tackle harmful content and online threats is that it has trouble recruiting and retaining enough employees, Haugen said, suggesting that the size of the company leaves staffers spread thin and makes oversight and action more challenging.<\/p>\n<p class=\" story-text__paragraph\" data-content-child-index=\"0-8\">It was a stunning claim given that Facebook, one of the world\u2019s wealthiest companies, is staffed with tens of thousands of workers and the company has touted additional hires around high-stakes events like the 2020 U.S. elections and the Covid-19 pandemic.<\/p>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/section>\n<section class=\"page-content__row page-content__row--story is-full-width-bleed\" data-ad-section=\"27\">\n<aside class=\"story-enhancement\">\n<div class=\"ad is-loaded\"><\/div>\n<\/aside>\n<\/section>\n<section class=\"page-content__row page-content__row--story main-section\">\n<div class=\"container container--story story-layout--fixed-fluid\">\n<div class=\"container__column container__column--story\">\n<div class=\"container__row container__row--story story-layout--fluid-fixed\">\n<div class=\"container__column container__column--story center-horizontally\">\n<div class=\"story-text\">\n<p class=\" story-text__paragraph\">\u201cFacebook has struggled for a long time to recruit and retain the number of employees it needs to tackle the large scope of projects that is chosen to take on,\u201d she said. \u201cFacebook is stuck in a cycle where it struggles to hire \u2014 that causes it to understaff projects, which causes scandals, which then makes it harder to hire.\u201d<\/p>\n<p class=\" story-text__paragraph\">Asked about her remarks, Facebook spokesperson Andy Stone said only that Facebook has more than <a href=\"https:\/\/s21.q4cdn.com\/399680738\/files\/doc_financials\/2021\/q2\/FB-Q2-2021-Earnings-Call-Transcript.pdf\" target=\"_blank\">63,000 employees<\/a>.<\/p>\n<h2>\u2018We\u2019re only at the tip of the iceberg\u2019<\/h2>\n<p class=\" story-text__paragraph\">\nHarbath said complaints that the whistleblower has filed with federal securities regulators &#8220;are just a little drop&#8221; hinting at what may be coming for Facebook. And given the enormous volume of documents she turned over to Congress, \u201cwe&#8217;re only at the tip of the iceberg.\u201d<\/p>\n<p class=\" story-text__paragraph\">Haugen\u2019s lawyers filed at least eight complaints with the Securities and Exchange Commission, alleging that discrepancies between Facebook\u2019s internal research and public statements may have misled investors. Those accusations could lead to shareholder suits and SEC enforcement action against the tech giant.<\/p>\n<p class=\" story-text__paragraph\">&#8220;There&#8217;s a lot more to come from this,\u201d Harbath said in an interview after the hearing. \u201cThis is sort of like halftime [that] we&#8217;re in right now, in terms of this cycle around the questions people are going to have. And my hope is, at bare minimum, it forces the company to be more transparent.&#8221;<\/p>\n<p class=\" story-text__paragraph\">Blumenthal posited that other tech whistleblowers exist, and that current Facebook employees could soon emerge as a result of Haugen\u2019s testimony.<\/p>\n<p class=\" story-text__paragraph\">\u201cShe&#8217;s provided encouragement to other whistleblowers,\u201d he said after the hearing, \u201cand I&#8217;m convinced there are others out there who will come forward.\u201d<\/p>\n<p class=\" story-text__paragraph\">Blumenthal also demanded that CEO Mark Zuckerberg testify before Congress about the internal research Haugen has made public, and he has also said the subcommittee may subpoena Facebook for additional records. Haugen said Tuesday that she is \u201cspeaking to other parts of Congress\u201d about concerns raised in the documents.<\/p>\n<p class=\" story-text__paragraph\">\u201cWhatever happens, Facebook has lost credibility in a way it won\u2019t be able to recover from easily,\u201d said Center for Digital Democracy\u2019s Chester. \u201cFrances Haugen has exposed the failures of Facebook management to protect the public, unleashing what will be an unbridled wave of regulatory investigations and litigation.\u201d<\/p>\n<p class=\" story-text__paragraph\"><a href=\"https:\/\/www.politico.com\/news\/2021\/10\/05\/children-facebook-whistleblower-congress-515203\">Politico<\/a><\/p>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/section>\n","protected":false},"excerpt":{"rendered":"<p>By Alexandra S.
