{"id":14734,"date":"2023-08-12T20:27:42","date_gmt":"2023-08-13T03:27:42","guid":{"rendered":"https:\/\/worldcampaign.net\/?p=14734"},"modified":"2023-08-12T20:29:14","modified_gmt":"2023-08-13T03:29:14","slug":"medical-centers-in-spotlight-as-another-us-doctor-accused-of-sexual-abuse-the-guardian","status":"publish","type":"post","link":"https:\/\/worldcampaign.net\/?p=14734","title":{"rendered":"&#8220;Medical centers in spotlight as another US doctor accused of sexual abuse&#8221;, The Guardian"},"content":{"rendered":"\n<p>Victoria Bekiempis&nbsp;in New York, 12 Aug 2023<\/p>\n\n\n\n<p><em>Case of Zhi Alan Cheng, accused of sexual abuse and rape, one of many that speak to institutional failures, <a href=\"https:\/\/www.theguardian.com\/us-news\/2023\/aug\/12\/doctor-medical-center-sexual-abuse-allegations\">advocates say<\/a><\/em><a rel=\"noreferrer noopener\" href=\"mailto:?subject=Medical%20centers%20in%20spotlight%20as%20another%20US%20doctor%20accused%20of%20sexual%20abuse&amp;body=https%3A%2F%2Fwww.theguardian.com%2Fus-news%2F2023%2Faug%2F12%2Fdoctor-medical-center-sexual-abuse-allegations%3FCMP%3Dshare_btn_link\" target=\"_blank\"><\/a><\/p>\n\n\n\n<p>When prosecutors last week&nbsp;<a href=\"https:\/\/queensda.org\/doctor-charged-with-sexually-assaulting-patients-in-hospital-raping-acquaintances-at-his-home\/\">announced<\/a>&nbsp;a litany of sexual crime charges against the New York City doctor Zhi Alan Cheng, their allegations presented a shocking description of apparent serial predation.<\/p>\n\n\n\n<p>Cheng, a gastroenterologist at New York-Presbyterian-Queens hospital, stands accused of sexually abusing three patients at the medical center \u2013 and raping three other women in his apartment.<\/p>\n\n\n\n<p>The 50-count indictment, to which Cheng has pleaded not guilty, came after his arrest in December 2022 on charges of raping another woman at his apartment; she allegedly encountered videos at his home that documented other alleged assaults. The woman\u2019s attorney then contacted authorities, leading to his arrest.<\/p>\n\n\n\n<p>After that woman came forward, authorities searched his apartment, finding a trove of videos purportedly depicting alleged assaults, prosecutors claim. They also allegedly seized recreational drugs; fentanyl, ketamine, cocaine, LSD and MDMA, in addition to powerful medical sedatives, such as propofol and sevoflurane.<a href=\"https:\/\/www.theguardian.com\/us-news\/2023\/aug\/12\/hawaii-fires-fresh-blaze-prompts-renewed-evacuations-as-maui-death-toll-expected-to-rise?traffic_source=Connatix\"><\/a><\/p>\n\n\n\n<p>What is even more shocking about Cheng\u2019s arrest is that the charges come in the wake of numerous prosecutions of other prominent doctors in New York and across the US on similar allegations that they violated patients at their most vulnerable moments \u2013 in a medical setting, where an inherent power imbalance puts them all the more at risk.<\/p>\n\n\n\n<p>Advocates for sexual abuse victims say the cases speaks to continued institutional failures.<\/p>\n\n\n\n<p>Medical facilities, they maintain, can do more to root out potential abusers before abuse takes place. Some are also calling for prosecutors to take action against institutions and their leadership if they don\u2019t act on suspected abuse \u2013 or cover it up.<\/p>\n\n\n\n<p>\u201cTo keep patients safe, transparency and accountability must be obtained through, for instance, proper background checks, periodic psychiatric evaluations, thorough supervision and continued amendments to criminal and civil laws relative to sexual abusers, supervisors and institutions legally responsible,\u201d said Mitchell Garabedian, who has represented sexual abuse victims for decades, securing&nbsp;<a href=\"https:\/\/www.npr.org\/2021\/08\/06\/1025500190\/more-clergy-abuse-is-finally-being-prosecuted-no-thanks-to-the-church-a-lawyer-s\">thousands<\/a>&nbsp;clergy abuse case settlements.<\/p>\n\n\n\n<p>\u201cAs a matter of healing and public safety, the irreparable damage caused to the [sexual assault victims] must end.\u201d<\/p>\n\n\n\n<p>News of the allegations against Cheng come two weeks after former Manhattan ob-gyn&nbsp;<a href=\"https:\/\/www.theguardian.com\/us-news\/2023\/jul\/25\/robert-hadden-gynecologist-sentenced-sexual-abuse\">Robert Hadden<\/a>&nbsp;was sentenced to 20 years imprisonment for sexually abusing numerous patients. Manhattan federal prosecutors said at trial that Hadden \u201cexploited the power differential inherent in the doctor-patient relationship and conducted bogus breast and vaginal examinations to conceal his abuse.<\/p>\n\n\n\n<p>The victimization unfolded in various ways, from illicit touching of victims\u2019 breasts and genitals. Hadden even \u201cextracted\u201d early breast milk from his victims and \u201ctasted it,\u201d prosecutors said.<\/p>\n\n\n\n<p>In April, the Manhattan US attorney\u2019s office&nbsp;<a href=\"https:\/\/www.justice.gov\/usao-sdny\/pr\/urologist-charged-sexually-abusing-patients\">announced charges<\/a>&nbsp;against New York City-region urologist Darius Paduch. They allege that between 2015 and 2019, Paduch \u201centiced and induced multiple victims to travel to his medical offices at Medical Institution-1, so Paduch could, among other things, sexually abuse the victims,\u201d including minors.<\/p>\n\n\n\n<p>Ricardo Cruciani, a New York City neurologist, was convicted in July 2022 for sexually abusing six patients. These women, who went to him for chronic and disabling pain disorders, were forced into non-consensual sex and he \u201coverprescribed serious pain medication in order to keep them in his care,\u201d Manhattan state prosecutors said. He died of an&nbsp;<a href=\"https:\/\/www.theguardian.com\/us-news\/2022\/aug\/15\/ricardo-cruciani-doctor-sexually-abused-patients-dies-apparent-suicide-new-york-jail\">apparent suicide<\/a>&nbsp;while jailed awaiting sentencing.<\/p>\n\n\n\n<p>\u201cThey\u2019re sick, but they\u2019re not the problem. They\u2019re just a symptom,\u201d said attorney Anthony DiPietro, who represents many of Hadden\u2019s survivors. \u201cThe problem is the institutions that cover this up, that lie to patients, that gaslight then and don\u2019t report the abuse to the state like they\u2019re required to do.\u201d<\/p>\n\n\n\n<p>DiPietro said that he has called on state and federal prosecutors to use racketeering statutes to pursue criminal cases against institutions\u2014and those who helm them\u2014in relation to any potential concealment of abuse.<\/p>\n\n\n\n<p>\u201cGo after the institutions because covering up a crime is a crime itself,\u201d DiPietro said. \u201cThe minute that there\u2019s a prosecutor in this country that files a RICo charge against an institution like this, watch how fast this stops. The administrators, the trustees ,the people who are bystanders in the institutions and turn their backs on patients, as soon as they have skin in the game, that\u2019s when this is going to change, that\u2019s when this is going to end.\u201d<\/p>\n\n\n\n<p>Neama Rahmani, president of West Coast Trial lawyers who previously worked as a federal prosecutor, said that there are practical ways medical institutions. Rahmani said doctors \u201cshouldn\u2019t be in the room by yourself with a patient\u201d.<\/p>\n\n\n\n<p>\u201cThere should always be someone else there. That\u2019s just best practice. A lot of it is just at the institution level \u2013 you just need better training.\u201d<\/p>\n\n\n\n<p>As for criminal cases against institutions and those leading them, Rahmani says it might not be a pragmatic approach. Prosecutors, who might well be risk-averse and don\u2019t want to pursue cases they might not win, see particular challenges in bringing charges against institutions.<\/p>\n\n\n\n<p>\u201cProsecuting institutions or entities, usually there needs to be some sort of knowledge,\u201d Rahmani said, not simply negligence, and likely that \u201cthey tried to cover it up.\u201d<\/p>\n\n\n\n<p>\u201cIt\u2019s much harder to prosecute third parties for the criminal conduct of others.\u201d<\/p>\n\n\n\n<p>When asked about the allegations against Cheng, New York-Presbyterian said in statement that in December, once they were apprised of prosecutors\u2019 allegations, \u201che was immediately placed off duty, banned from hospital property, and terminated.\u201d<\/p>\n\n\n\n<p>\u201cWe have been fully cooperating with the Queens District Attorney\u2019s office, the NYPD, and the NYS Department of Health,\u201d the health system said in a statement.<strong><\/strong><\/p>\n\n\n\n<p>Asked for comment, Cheng\u2019s attorney, Jeffrey Lichtman, said: \u201cWe recognize how serious the charges are and hope to soon review the evidence with our client.\u201d<\/p>\n\n\n\n<p><em>&nbsp;Information and support for anyone affected by rape or sexual abuse issues is available from the following organisations.
